Introduction
Through and during your visitation to, navigation of and access to information made available on this web site, www.Quova.com (or the “Site”) owned and operated by Quova, Inc., Quova may collect non-personally identifiable information and, should you choose to provide it, personally identifiable about you. We have established this Privacy Policy because your privacy is extremely important to us and we want you to understand the information we collect, how it is used, and the manner in which your rights to privacy and confidentiality are respected and protected.
Collection and Use of Personal Information
Non-Personally Identifiable Consumer Data
Each time you visit the Site, our web server automatically recognizes and collects your IP address, domain, the type of Internet browser you are using, the type of computer operating system you are using, and the domain name of the referring web site from which you linked to the Site. Quova uses this non-personally identifiable information for the purpose of analyzing site usage trends (e.g., by tracking user movement through the Site), to gather broad demographic information for aggregate use, and to technically administer the Site by, for example, monitoring traffic and usage. We collect and use this information for internal business purposes only, and we maintain appropriate reasonable security measures to keep this information private from third parties and the general public.
Personally Identifiable Consumer Data
The Site currently is designed to inform interested users about Quova and to collect certain personal contact information from such users, who may choose to provide it entirely on a voluntary basis. This information may include, but is not limited to, name, email address, street address, and phone number data. Our web server collects information about certain actions you may take within the Site, such as filling out forms and information provided therein, downloading files, etc. If submitted, this personally-identifiable information may be used by Quova for various purposes, including to:
- Contact a user about Quova’s services, as well as other products or services that we believe may be of interest to that user;
- Send promotional materials;
- Provide a free email newsletter;
- Obtain feedback through surveys on our products, the Site or other aspects of our business that may have an impact on the user as a Quova customer or potential Quova customer; and
- Otherwise support our marketing and business purposes.
Security and Protection of Information
Quova makes diligent efforts and takes reasonable proactive steps to maintain the security of its network and both the personally identifiable and non-personally identifiable data we collect. We use various methods to ensure high security standards and provide protection against the unauthorized access to and the disclosure, loss, misuse, alteration and destruction of such information under our control. Any data that is stored on Quova’s servers is treated as confidential and is not generally available to the public. Quova has an internal security policy with respect to the confidentiality of certain of our data, limiting access to it only to those employees who we believe need to know it for the performance of their jobs. Our employees are made aware of and are accountable for compliance with Quova’s security procedures and policies. However, because the Internet is not (and probably can never be) a one hundred percent secure medium, the possibility of someone defeating or circumventing our reasonable security measures always exists and we cannot guarantee that our security measures will prevent, for example, third-party “hackers” from illegally obtaining stored information.
Sharing Information with Third Parties
Neither Non-Personally Identifiable Consumer Data nor Personally Identifiable Consumer Data collected by Quova on the Site will be leased, sold, rented or otherwise made available to any unrelated third party except to the extent set forth in this Privacy Policy.
Notwithstanding the above, Quova reserves the right to use a third-party service provider to collect, process, store or otherwise handle information on Quova’s behalf. In such event, Quova would require such third-party service provider to process your information only as authorized by Quova to fulfill the service(s) that it has been contracted to provide and only in accordance with appropriate privacy safeguards. In addition, Quova may assign, sell, license or otherwise transfer to a third party Personally Identifiable Consumer Data and Non-Personally Identifiable Consumer Data in connection with an assignment, sale, joint venture or other transfer or disposition of all, substantially all or a material portion of the stock or assets of Quova. Information collected by Quova on the Site, whether personally identifiable or non-personally identifiable, may be disclosed to third parties as necessary to comply with applicable laws, cooperate with lawful investigations of government or law enforcement officials, in legal proceedings where such information is relevant, or otherwise pursuant to judicial or governmental subpoena, warrant or order.
Links to Non-Quova Web Sites
The Quova Site contains links to sites on the Internet maintained by others; e.g., business partners of Quova. Quova does not review such third-party sites and is not responsible for the contents of, or any products and services offered in, such third-party sites. Quova is not responsible for the privacy practices of such sites. We encourage you to be aware when leaving the Quova Site and to read the privacy statements on each and every web site that collects personal information. Quova provides these links only as a convenience to you and to the operators of these web sites, and the inclusion of any link on the Site does not imply the endorsement of, or acceptance of any responsibility for, any non-Quova web site or the contents thereof.
Cookies
The Site uses cookies for the limited purpose of assisting the collection by our third party web analytics provider of anonymous web surfing traffic data (sometimes referred to as “Clickstream Data”) on web surfers who visit the Site. None of this Clickstream Data is personally identifiable. “Cookies” are small pieces of data transmitted to a browser and saved by the browser for future reference by means of a small text file that contains a string of alphanumeric characters. The use of cookies has become an industry standard for many, perhaps even most, of the thousands of companies conducting business on the Internet. These cookie files are harmless to your computer. Quova may use cookies to track visits to the Site to ensure that the content provided is best suited to Quova’s customers’ preferences and interests, to test whether cookies are working, and to support our own marketing purposes. There are two kinds of cookies: persistent cookies and session cookies. A persistent cookie gets entered by your web browser into the “Cookies” folder on your computer and remains in this “Cookies” folder after you close your browser. Persistent cookies may be used by your browser on subsequent visits to a web site. A session cookie is held temporarily in your computer’s memory and disappears after you close your browser or shut off your computer. The Site contains session cookies in conjunction with the collection of Clickstream Data. The cookie information can only be read by the entity that authored the cookie, and provides no personally-identifiable information about the individual who is using the computer (only about the computer used to access the Web through its IP address).
Web Beacons
The Site uses web beacons. Web beacons are electronic files (also called “clear GIFs” or “pixel tags”) containing a small string of code that companies place within web pages on their websites (often in conjunction with cookies) to help them track their marketing campaigns, count users who have visited that page, and record the general usage patterns of visitors to their web sites. In general, any file served as part of a web page can act as a web beacon. A GIF is a type of graphic that often appears invisible because it is only 1×1 pixel in size. GIFs are represented by HTML tags programmed to collect certain anonymous, non-personally identifiable individual or aggregate Clickstream Data about the visits of web surfers to the Site, which may be used by Quova for research purposes and testing of software. Aggregate information may include demographic and usage information. None of this Clickstream Data by itself, or together, can by its nature be tracked to a specific individual. In addition to using web beacons on the Site, Quova’s practice is to include web beacons in HTML-formatted email messages (messages that include graphics) that Quova or its agents send, in order to determine such things as which email messages were opened, the date and time each email was viewed and whether the message was acted upon.
Quova also may include web beacons and session cookies from third parties (such as our web analytics provider) within Site pages served by Quova so that such parties can receive anonymous, non-personally identifiable individual or aggregate information about the traffic of web visitors to the Site. No Personally Identifiable Consumer Data about you is shared with such third parties. Quova has no access to or control over these third party web beacons and session cookies. This Privacy Policy covers the use of web beacons and cookies by Quova only, and does not cover the use of web beacons and cookies by any third parties.
European Union Web Visitors
European Union web surfers understand and consent to the processing of personal information in the United States in accordance with United States law and regulation.
Children’s Privacy
The Quova Site is not designed for, nor is intended to attract, children under the age of 13 years old. Accordingly, Quova does not intend to collect information from anyone we know to be under 13 years old. If you believe your child has provided Quova with personally-identifiable information or otherwise registered at the Site, and you would like to have the information removed, please contact us.
Access to Data
Quova allows individuals who have voluntarily provided personally identifiable data access to their data to ensure that it is correct and to make any changes. Please contact us, as set forth below, to do so.
Opt-Out Policy
Data
If an individual elects to provide Quova with personally-identifiable data, he or she has the right to tell us not to make some of the uses of such data described in the Quova Privacy Policy or to have such data deleted in its entirety at any time. Simply contact us as indicated below or at Optout@Quova.com and let us know what level of opt-out you would like to exercise or request that your data be removed from Quova’s database. Once we receive this request, we promptly will take corrective action. Please note that Quova will need you to provide your email address or other previously-provided personal identifier in order to identify you in the Opt-Out process.
Cookies
Quova believes that cookies serve many useful purposes for the Internet community, of which the Site is a part. Nevertheless, Quova also fervently believes that every individual who uses the Internet should be entitled to make informed decisions with respect to individual privacy matters, including the use of cookies. If you do not want your browser to use or track cookies, you may disable cookies by adjusting the preferences on your Internet browser, an option provided by most current modern browsers. Most such browsers permit you to remove cookies that have been previously stored, as well as prevent the future use of cookies. Disabling cookies in this fashion will not prevent you from accessing the Site or its contents in any way.
Changes to this Privacy Policy
The issue of privacy is an evolving one. Quova is committed to the frequent monitoring and examination of its privacy practices and therefore Quova reserves the right to modify this Privacy Policy at its discretion from time to time. In the event any modifications are made, the updated Privacy Policy promptly will be posted on the Site.
This Privacy Policy was most recently updated May 11, 2009.
